2013 Recovery Outlook
2013 is proving to be an interesting year. Initially there will be a slight downward trend that is most likely temporary in light of more than $42 billion paid to investors from settlements over the past seven years. A consistent and longer-term upward trend appears likely in response to two primary factors. Settlements from the financial melt down are just beginning to reach maturity and these cases will continue to fill the pipeline for years to come. The second factor is that global settlements and claims are projected to see a significant increase due to more favorable legislation in Europe.

Non US securities class action settlements will likely exceed $8.5 billion annually by 2020. If non participation rates remain constant, this will leave approximately $2 billion dollars unclaimed every year. 

Finally, institutional investors are under increasing pressure to not only file, but also initialize cases on behalf of investors. According to the Wall Street Journal, "public and private pension plans are losing out on hundreds of millions of dollars in class-action settlements for which they are eligible simply by neglecting to file claims. Increased investor oversight and access to reporting data will likely produce increased activity over the next decade both in the United States and abroad.
